These Conditions of Sale are equivalent to a contract in all respects between Spade Della Forza Di Cellini Raffaele (henceforth referred to as SDF) and the Customer who has accepted below mentioned conditions when placing the order.
LEAD TIME
1.1. Realization (^Back To Index^)
The Realization of the swords is entrusted to our technical laboratory, which, at the time of the order, will source, make and assemble all the parts that make up the final product.
1.2. Timing(^Back To Index^)
Making a sword from scratch (Customizable Swords) usually takes from 7 to 45 Days, the long timelines are mainly dictated by the availability of raw materials and the making of the various components.
Prompt delivery swords normally ship in 2/3 Business Days.
2.1. Shipping(^Back To Index^)
The shipment of products will be entrusted to Industry Professionals(Generally GLS, SDA SGT or DHL), the carriers involved will be responsible for transporting the package from the departure address to the destination address in the shortest possible time, generally 24/48h.
During high flow periods, shipments may be delayed for reasons beyond SDF's control.
2.2. Shipping costs(^Back To Index^)
Shipping costs will be borne by the customer and will consist of the cost of packing the product, the bureaucratic costs of sending and shipping the product.
These charges, being out-of-pocket costs, will not be refunded under any circumstances after the product is sent.
2.3. Packaging(^Back To Index^)
Swords Of The Force will make every effort to package products in the best way possible to avoid shipping damage. (Packaging could be recycled to avoid waste).
We recommend that you properly recycle packaging by using your city's recycling service.
In case of pickup by appointment, the product will be unpacked.
2.4. Ancillary services(^Back To Index^)
Only upon request and only prior to order placement may the customer request ancillary services for deliveries such as deliveries before a set time or other.
2.5. Tracking Code(^Back To Index^)
As the paperwork for the package is processed, a tracking code will be generated and sent to the customer at the time of shipment. This code allows the location of the parcel to be tracked and verified in real time. Depending on the courier chosen, the portal for tracking the parcel will be different.
2.6. Delivery(^Back To Index^)
Delivery of the product will take place on weekdays (Mon-Fri) in the time slot 8-18, the Courier will go to the address entered in the order and proceed to deliver the package to the recipient.
In case the courier does not find the recipient it will try a second delivery the next day.
In case the address does not correspond to a real address the package will go into storage, you will be contacted to define the terms for releasing the storage.
SDF is not responsible for any loss due to entering an incorrect or incomplete address.
2.7. Withdrawal(^Back To Index^)
Pickup by appointment gives the customer the opportunity to personally pick up the product at the production workshop, pickup by appointment is Free and has no additional cost. Pickup will be by appointment only, the appointment will be arranged directly with SDF. The order with pickup by appointment will be considered valid only after payment is received.
From the time the package is delivered to the Customer SDF will no longer be responsible for transportation to the home or destination of the product.
2.8. Pickup with Own Courier(^Back To Index^)
There is the possibility of being able to pick up one or more parcels with Own Shipping contract, this procedure will have to be arranged with SDF before making the pickup, no parcels will be delivered to couriers without prior arrangements.
From the time the package is delivered to the courier, SDF will no longer be responsible for any shipping damage attributable to the courier.
2.9. Foreign Shipments(^Back To Index^)
There is an option to be able to send your sword abroad, just select your state and area of residence when completing your order. (in case it is not present please contact us)

Any Customs Taxes are in no case to be borne by SDF, the customer will discharge all charges for the import of the product.
2.10. URGENT SHIPMENTS (New November 2020)(^Back To Index^)
When checking out from November 2020, a new possibility to classify the order as "URGENT ORDER" has been included this service has an ancillary cost defined according to the quantity and type of products included in the order.
Orders marked "URGENT SHIPMENT" will be handled and processed in a shorter time than normal procedures.
SDF operators once they receive an urgent order will check the possibility of handling the order in a short period of time, in case it is not possible for various reasons (lack of material, timing too tight, travel or trade fairs...) operators will contact the customer as soon as possible communicating the expected timing and agreeing on any changes to speed up the handling time.
3.1. Timing(^Back To Index^)
Payment must be made no later than 7 Days after order placement, past this date SDF may declare the order void.
3.2. Mode(^Back To Index^)
Payment may be made according to the methods defined below, no other payment methods will be accepted unless previously agreed with Swords Of Strength, in case of incomplete or partial payment the order will not be considered completed.
3.2.1.Bank Transfer(^Back To Index^)
By selecting this method of payment, the customer must adhere to the following procedures: the bank transfer must be made no later than the next 5 Business Days after placing the order (or the order will be cancelled).
Normally banking institutions take about 2 Working Days to credit the payment until then the order will not be considered completed.

Selecting this method of payment will directly credit your card, payment is made in a secure environment not owned by SDF, under no circumstances will SDF receive sensitive data or codes.

The payment platform will require additional security such as phone codes or PINs for order completion. Check before placing your order to see if your card is enabled for online purchases.

Selecting this method of payment will make the transaction through Paypal circuit. During payment, the site will direct the customer to the paypal Landing Page to make the payment, the customer will take care to correctly enter all the data to complete the transaction.
Payment through Paypal does not take place on our servers, no sensitive data is transmitted to the seller.
In case of unsuccessful payment, the customer will be in a hurry, within 5 Working Days (under penalty of cancellation of the order), to make the credit through the "send money" function of Paypal.

Selecting this method of payment will make the transaction via Satispay circuit. During payment, the site will direct the customer to the Satispay Landing Page to make the payment, the customer will take care to correctly enter all the data to complete the transaction.

4.1. Product Warranty(^Back To Index^)
According to D. Lgs 206/2005 (Consumer Code) the Seller is obliged to Guarantee to the consumer the operation and the absence of defects or faults according to the characteristics and qualities described during the Sale. The Warranty has a duration of 24 Months from the Date of Purchase. The Seller is required to Replace or Restore the defective product.
4.2. Warranty Replacement or Repair(^Back To Index^)
If the purchased product has factory defects, the customer may request replacement or repair under warranty, the customer will undertake to contact SDF's service department to report the defect and illustrate with audio-visual such defects. The technical department will analyze the request and proceed by sending replacement parts, if the case requires it, arranging the return of the product for laboratory repair or replacement.
Replacement or return is not applicable to products with unique customizations (engravings, logos, special requests...).
4.3. Blade warranty(^Back To Index^)
The blade is not covered by warranty. It will be replaced only in case of defects or factory defect within 14 Days of receiving the package.
In case of tampering or modification, the warranty will be immediately void.
4.4. Hilt warranty(^Back To Index^)
The hilt is not covered under warranty for accidental, intentional or drop damage. Only in the event of a factory defect will warranty repair or replacement be available, subject to verification by the technical department. The hilts are made and designed to withstand combat; in the event of a fall, impact against objects or any misuse, the warranty will immediately expire.
In case of tampering or modification, the warranty will be immediately void.
4.5. Modification or Tampering(^Back To Index^)
Any modification or tampering with the product, even cosmetic, will void the warranty. It will be the responsibility of the technical department to verify the integrity and proper use of the product.

Online Trading and Selling is regulated by Legislative Decree 206/2005 Art. 45 to 67 (Consumer Code). The above decree regulates the sale between Professional and Consumer outside business premises or at a distance.

The consumer has the right to withdraw from the contract, without giving any reasons, within 14 days from the day on which the consumer (or a third party other than the carrier) acquires physical possession of the goods. The Request should be sent no later than the expiration of the timeframe in step 5.2.
To exercise the right of withdrawal, the consumer is required to inform SDF of his decision to withdraw from this contract by an explicit statement (Letter, Fax, E-mail...).
5.4. Refund(^Back To Index^)
In the event of withdrawal from this contract, you will be refunded all payments you have made to us, including delivery costs (except for additional costs resulting from your possible choice of a type of delivery other than the least expensive type of standard delivery offered by us) within 14 Days after we receive notice of your wish to withdraw from this contract. Suddetti refunds will be made using the same means of payment chosen for the initial transaction, unless otherwise agreed, made directly with the consumer. Refunds may be suspended until receipt of the goods or until the consumer demonstrates that he or she has returned the goods, whichever is earlier.
The Customer is responsible for the decrease in the value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics and operation of the goods.
5.5. Sending products(^Back To Index^)

The direct costs of returning the goods will be borne by the consumer, who will consequently be responsible for shipping.
5.6. Exceptions(^Back To Index^)
The Right of Withdrawal is not applicable in the following cases:
- Tailor-made or customized goods.
6.1. Communication(^Back To Index^)
Communications with SDF for product cancellation, modification or replacement can be delivered by email to info@spadedellaforza.com or through the messaging function of the e-commerce site https://www.spadedellaforza.com/en/module/dgtranslationall/urlstranslation.
Customer and order references should be included in the communication.
6.2. Cancellation of the Order(^Back To Index^)
The request to cancel the order must be made in the manner described under 6.1.
If payment has already been made Swords Of The Force will undertake to reimburse the customer for the total amount of the order less expenses incurred.
6.3. Replacement(^Back To Index^)
The request for order substitution must be made in the manner described under 6.1.
The Customer may request the replacement of the product with another product that is not the same. Following confirmation by Spade Della Forza of the replacement, the Customer will undertake to send the product (in the manner described in the next point) by including all items originally present (instructions and accessories) in the package.
Only after the receipt and verification of the integrity of the product and packaging SDF will calculate and communicate the costs for the replacement of the product; this amount will be calculated by adding the shipping costs of the new product, costs for the restoration of the original packaging and any price difference between the replaced products. The customer will undertake to settle this amount in the manner explained in Section 4.
After receiving the difference SDF will start a new process of making and shipping the replacement product to the customer.
In the event that the customer refuses to pay the difference or no longer wants to make the replacement, the product will remain available for pickup, by the customer or third party appointed, at SDF's warehouse.
6.4. Product Submission(^Back To Index^)
The customer who has to send products to SDF's operating site should follow the following directions:
-Pack the product as best as possible to avoid shipping damage(any damage will be the responsibility of the sender).
-Place a document inside the package describing the reason for sending the customer's references and order number (various forms are available for returning products).
-Remove or cover any labels, addresses, or codes in reference to previous shipments already affixed to the package.
Shipping charges such as any shipping damage will be the responsibility of the sender, we recommend insuring the package.
